Municipal Court is the lowest court of this land. The process of dealing with this “court” is tenuous at best. Despite repeated requests for a speedy trial I was not able to face my accuser for 353 days. Statutorily, WI allows the state 60 days for misdemeanor and 90 days for felony speedy trials.

April 30, 2013 I was “convicted” of loitering and disorderly conduct while filming this video.  My accuser was Milwaukee PD officer Jason Kotarak. My prosecutor was former MPD officer Vince Bobot with 21 years on “the force.” And my “Judge” was former MPD officer Patrick Moczynski.

Arresting officer Jason Kotarak has been with MPD for over a decade. He’s rides a motorcycle for MPD and according to his court testimony, he is a part of CODE RED. I guess that’s the special unit which oppresses free speech down in the bar district on Saturday nights. He had some other interesting things to say that will be re-hashed during the De Novo appeal trial.

Reserve “Judge” aka Officer Patrick Moczynski was a member of Milwaukee PD back during the 80′s at least. There is an old newspaper article which confirms him as a cop in 1989. He may have retired from MPD. He is now a reserve Judge for Milwaukee County. He is not an elected Judge and is not even a lawyer. I’m in the process of trying to figure out what qualifications a person must have to hold this appointed position.

Prosecutor Vince Bobot worked for MPD for 21 years from 1971 to about 1992.  He worked at MPD during the same time the Judge in this case worked for MPD. Are these guys friends? Vince is also a former Judge in the very court he prosecuted me in.  He previously ran for mayor and sheriff in Milwaukee.  With his high hopes dashed, Bobot recently settled for the “board of the Social Development Commission as a write-in candidate” according to JSOnline. He is quoted in the article as planning “to restore the credibility” of said agency.

As you can imagine these 3 cops had a field day with me in court. I guess that is to be expected when police from the same department are the accusers, the prosecutors, and the judges.

Apparently this is how a fair trial happens in Milwaukee. I will appeal these convictions as far as I can.
